“I think that that becomes a really personal way to look at a lawsuit. The special damages are certainly important because to not get those covered, means that the policyholder, or my client, that’s out of their pocket. They didn’t do anything wrong. Somebody else did something to them, and now they are having to pay money out of their pocket. So, getting that, them made whole there is very important.
But I also think the general damages, the pain and suffering, is important also. If you’ve ever had any sort of back injury, it can be debilitating on your daily life. Just a soft tissue back injury can affect everything about your day. Certainly, if you’ve got a broken bone or a situation that requires surgery, I mean those are invasive injuries. Assigning value and obtaining value for a client is important.”
