“So, the basis of, really, the justice system when you are harmed, is that the justice system is there to make sure you are made whole. So, your rights are to make sure your medical bills are covered. That really depends a lot on…do you have personal injury protection policies on your cars? Or do you have health insurance? Do you have medical insurance companies that are going to be paying for your bills as you go along? Because one of the things that you’ve got to be concerned about, as the harmed party, is out-of-pocket expenses.
One of the rights you have is to make sure that those out-of-pocket expenses are reimbursed by the at-fault party. The second thing is to make sure that your, what they’re called general damages, are compensated for. For people, the most common thing they hear is ‘pain and suffering’. That you’re made whole. And it’s hard to put a dollar on that value, but that’s what we try to do, is to put a dollar value on that ‘pain and suffering’, depending on the severity of it and the duration of it.”
