“You’ve handled obviously, a plethora, a great number of DUI arrests in your criminal defense career. What are some of the common myths that persist even today? You know, out in the public, that when they walk into your office, they ask a question, and it’s a common myth that is just pervasive.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“One of the biggest ones is… I’ll just sleep it off in my car. I can’t get arrested for DUI. I’m not driving!”
Ray Hrdlicka – Host – Attorneys.Media
“Oh.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“Big wrong. If you are close, if you’re sleeping in the car, and your keys are right there, next to you and your purse, then you have the ability to get up and drive. I have seen many officers wake people up to arrest them for DUI.”
Ray Hrdlicka – Host – Attorneys.Media
“Oh my gosh.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“Your car will not avoid a DUI. It actually might make the DUI come faster, cause they’re going to notice that the car’s not going anywhere. And people are trying to do the right thing by not driving, and they’re still getting DUI’s. And it’s frustrating, because the person is trying to do the right thing. They’re like, well, I’m not moving. I’ve parked it. But, you know, somebody will say, hey, there’s a weird car park across the street. And the cops will come, and then they’ll see the person sitting there, and many times they pound it on the door, get them up, wake them up to conduct the DUI investigation.”
Ray Hrdlicka – Host – Attorneys.Media
“Wow.”
Regina Tsombanakis– Criminal Defense Attorney – Broward County, FL
“That’s one of the most pervasive. And unfortunately we see a lot of people get arrested.. sleeping in their car.”
