As a defense attorney, what would you tell… because you’re obviously not going to be there when they get pulled over. But what advice can you give a person when they get pulled over and they know they’ve had a drink, they’re getting pulled over, more than likely they’re going to have to do some field sobriety tests. But what would you tell them? What legal advice would you give them at that moment?

Lawyer…Lawyer… Lawyer. And you do the field sobriety tests, because you have to, you provide the urine tests, the blood tests, or the grav tests, because you’re obligated. A lot of people think, I don’t have to do that. No, you do. Because driving is not a right, it’s a privilege. They will give you a year suspension if you do not make yourself available to be tested.
So never…never resist or refuse to get tested, because that’s going to be worse. But you don’t have to say what you were doing, where you came from, or what you were drinking. Those are basic questions that they always ask.
And most people say, I had two beers. I’ve seen that, like, 25,000 times in reports, and they think that means they’re ok. But it’s better to just say, “lawyer, I invoke my right to remain silent. I’ll do whatever you ask me to do. But I’m not answering your questions. You’re not getting my statement.”
