“Does social media come into play in getting a person like that to agree? When I say social media, meaning all the rating systems that are out there on social media. Now, has that changed from years past to current date? Because there seems to be more external pressure to have people do the right thing?”

“And you asked at one another time, is it…you said, the business may not be able to keep all the customers happy all the time. And so, what happens when you, when you try to protect yourself with contracts, disclaimers, posted notices and so forth. The public has… And by public, in this case, I also mean businesses, not just individuals, not just persons. And they have certain avenues to proceed.

First of all, are there any contracts involved? If there are contracts involved, we’ve got to look at the contract and see what are the rights of the person who wants to pursue against the business. Second, you look at the law. Did they violate some legal statute? Third, you go to public relations. And that’s where social media comes in. So, if they’re going to suffer in public relations, they might need to reconsider what their point of view is.

And finally, it may be just a cost of doing business. At some point, if you say, well gee, I know I’m not going to be hurt too badly by public relations. I know the public doesn’t care. The law… it doesn’t say anything about this, and we don’t have a contract. But dang it, I just don’t want to be bothered by this. So, I’m just going to pay this person off. And they might consider it a nuisance claim, but that sometimes is just a cost of doing business.”
